It's pretty simple. If Bob the Electrician gets caught busting some windows, don't confiscate his Device Analyzer because doing that is basically the same as demoting him since he's got no way to do his job now.

If taking the item would make it impossible for them to do their job, and you weren't going to try and have them demoted anyway, don't take it.
